War crime against the civilian population from Article 142 (1) of the CC of the FRY, in connection with Article 22 of the CC of the FRY.

Background facts

As a member of the Army of the Republika Srpska, on an unspecified day in late July 1992, in the afternoon, together with BB from Pištanica and another NN member of the Army of the Republika Srpska, in army uniforms and armed with automatic rifles, the group came to the house of the injured AB in the settlement of Donja Sanica, Šljivari hamlet, Ključ Municipality, and threw the victim AB, a civilian of Bosniak nationality, out of the house by force and at gunpoint. He was then taken to a place called Božin Mlin in Donja Sanica, located right next to the Sanica River, at which place they fired several bullets at the injured party and thus deprived him of his life, proceeding to throw his body into the Sanica River.

Procedural remarks

Pursuant to the provisions of Article 47 (1) of the Law on International Legal Assistance in Criminal Matters, the prosecutor issued an indictment confirmed by the Cantonal Prosecutor's Office of the Una-Sana Canton of Bihać, B-H, according to the laws of the Republic of Serbia.
