Supreme Court adopts RPP's request for protection of legality


Pursuant to its judgment Kzz RZ I/21 of 06 July 2021, the Serbian Supreme Court of Cassation adopted the Republic's Public Prsecutor's request for the protection of legality (ref. KTZ no. 556/21 of 02 June 2021), filed against the final judgment rendered by the War Crimes Department of the Appellate Court in Belgrade (ref. KžI 2/20, dated 20 October 2020). In to the Supreme Court's opinion, the Appellate Court's final decision KžI Po2/200 of 20 November 2020 was rendered in breach of articles 450 (6) re 236 (1), (3) re 239 (7) of the Criminal Procedure Code.

Background facts

According to the indictment allegations, on 10 October 1991, in an attack launched on village Lovas, Croatia, units of the Yugoslav People’s Army (JNA) under the command of the accused AG took the lives of 20 Croat civilians. Subsequently, pursuant to orders issued by AA, AV and AB, at the time heads of the provisional government, some of the individuals accused in this case engaged in a series of crimes against Croat civilians. Inter alia, they used the civilians as human shields and forced them into a minefield.

Procedural remarks

On 24 April 2015, a hearing was held in separate proceedings against AB, one of those indicted in the Lovas case. The court had earlier separated the case against AV due to his health condition. At its hearing of 24 April 2015, the court ordered medical expertise on this defendant's ability to stand trial.
Proceedings against the remaining defendants were continued on 29 and 30 April 2015.
